These terms and conditions outline the rules and regulations for the use of the SHAPE IAS Website and SHAPE IAS APP, located at https://www.shapeias.com.By accessing this website we assume you accept these terms and conditions. The term 'SHAPE IAS' or 'us' or 'we' refers to the owner of the website. The term 'you' refers to the user or viewer of our website. The SHAPE IAS APP and SHAPE IAS Website, on which the services are availed, will be hereinafter collectively referred to as Platform. We request you to read the Terms of Use thoroughly, before using the Platform as it governs your use of the Platform and any other applications, products, websites and services owned and managed by the firm.

By enrolling in our program, you agree to abide by the following terms and conditions:

Amendments: The coaching institute reserves the right to modify or amend these terms and conditions at any time. Candidates will be notified of any changes, and their continued participation in the SHAPE IAS program will imply acceptance of the modified terms. 

Conduct:

Candidates are required to adhere to a code of conduct and maintain a respectful and professional demeanour towards faculty, staff, and fellow candidates. Any behaviour deemed inappropriate, including harassment or discrimination, will not be tolerated and may result in immediate termination of enrollment.

Candidate Responsibilities:

Candidates are expected to attend classes regularly, complete assigned coursework, and actively participate in the enrolled program. 

 Confidentiality:

Candidates must maintain the confidentiality of any confidential information shared during the SHAPE IAS program, including the personal information of faculty and fellow candidates. Sharing such information without consent may result in legal action. 

Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

The student must not attempt to breach the security or misuse the online learning platform. 

 Course Materials:

a. The coaching institute will provide study material, either in physical or digital format, as part of the course.

b. The student is responsible for the proper use and preservation of the provided study material.

c. The student may not reproduce, distribute, or share the course material without explicit permission from the coaching institute.

d. All study materials provided as part of the coaching program are copyrighted and intended solely for personal use. Redistribution or reproduction of the materials is strictly prohibited. 

Intellectual Property:

All study materials, lectures, and resources provided as part of the coaching program are copyrighted and owned by the SHAPE IAS. Candidates are strictly prohibited from reproducing, distributing, or sharing any copyrighted material without prior written consent.

a. All intellectual property rights for the coaching material, including online content, study material, resources, design, layout, look, appearance and graphics belong to the SHAPE IAS. b. Unauthorized use, reproduction, or distribution of the coaching institute's intellectual property is strictly prohibited.

Liability:

a. The SHAPE IAS is not liable for any direct or indirect damages, losses, or injuries incurred by the student during the course.

b. The SHAPE IAS does not guarantee the student's success in the UPSC IAS or PCS examinations. 

This website contains material which is owned by or licensed to us.

From time to time, this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

Payment:

a. Payment for the coaching program should be made as per the designated fee structure.

b. Failure to make timely payments may result in the cancellation of enrollment.

c. Payment can only be made through various Online Media.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. 

Your use of this website and any dispute arising out of such use of the website is subject to the laws of India or other regulatory authorities.

SHAPE IAS may also contact the user through sms, email and call to give notifications on various important updates.**** Therefore, the User holds SHAPE IAS non-liable to any liabilities including financial penalties, damages, and expenses in case the user, mobile number is registered with the Do Not Call database. In the event of a breach of the terms and conditions of this Terms of Use by the User, the User shall be promptly liable to indemnify SHAPE IAS for all the costs, losses and damages caused to SHAPE IAS as a result of such a breach.

And acknowledge that SHAPE IAS is not responsible to ensure that You conform to the eligibility criteria. To seek the consent of Your parents/legal guardians, in case you are a minor, before providing any information about Yourself or Your parents and other family members, on the SHAPE IAS website or app.

That We are not responsible or liable for any consequences, that arise as a result of misuse of any kind, by You, in the SHAPE IAS app, SHAPE IAS Website or any of Our services, such that it causes any harm or injury to a third party.

We reserve the right to change and update the content in the Platform to represent the latest evidence and practices, with the changing times, needs and requirements. We reserve the right to constantly review, update and replace the content and features of all the Study Materials, including but not limited to Test Series, Videos and Notes, which would be carried out on a yearly basis. 

That We reserve all right to engage a different faculty or tutor or change the current faculty or tutor at any given point of time without any prior notification to the User.

If You provide any information that is untrue, inaccurate, not current or incomplete, or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Platform.

This document is an electronic record in terms of the Information Technology Act, 2000 (IT Act) and the Rules as applicable, thereunder, and the provisions pertaining to electronic records in various statutes as amended by the IT Act. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Access:

Upon successful enrollment, you will be provided with login credentials to access the online coaching platform. The login credentials are strictly for personal use and should not be shared with others.

Post receipt of the payment in full, the user shall normally be required to submit one valid identity proof issued by the Government of India i.e. Aadhaar Card, Passport, Voter’s ID, etc. as acceptable by the Us.

By registering Your e-mail address and/or phone number with Us, You consent to be contacted by Us via phone calls, SMS notifications, e-mails and/or any other means that help us reach You, in case of any subscription or service updates.

You are entirely responsible for maintaining the security and confidentiality of Your account as well as the login credentials to the account once you become a ‘registered User’.

We will not be liable for any loss that You may incur as a result of a third party using Your account, either with or without Your knowledge. You may be held liable for any losses incurred by Us as a consequence of third-party usage of Your account. 

We may use/integrate another third party’s platform on Our Website or the SHAPE IAS App. We may also use third-party platforms to provide services to ourselves. In such event, You will be bound by such third party’s terms and conditions, privacy policy, and any other applicable policies. You also agree and hereby authorize SHAPE IAS to share Your details and personal information with such third parties to the extent necessary for SHAPE IAS to deliver the Services to You.

SHAPE IAS hereby notifies You that SHAPE IAS uses third-party payment gateway service providers to process payment made by You towards the Service subscription. It is hereby clarified that SHAPE IAS will not be responsible for any payment failures or errors occurring due to technical issues at the bank’s end or issues arising from the third payment gateway and all such issues should be resolved directly between You and the banking or payment gateway partner concerned.

If any sum payable is not paid on or before the due date, SHAPE IAS reserves the right, forthwith and at SHAPE IAS's sole discretion, to suspend Your access to the Services and refuse You entry to the course You intended to avail as part of the subscription to the Platform.

A subscription received is personal to You and You shall not transfer or share your right to access the Study Material or further sell the subscription or allow access to the subscription to any other person for consideration or otherwise. Such acts will be construed as contrary to this Terms of Use and in such a situation we reserve the right to suspend or terminate access to Your account, with or without prior notice.

We reserve the right to make modifications, enhancements or issue clarifications (for example, clarification of doubt, interactive sessions) to the subscription, including but not limited to changes in Services, number of Services available, pricing and validity of Subscription duration.

We do not guarantee that the contents or features of the previous versions/Editions would be made available post the launch of the new edition.

Technical Requirements: To access the online coaching platform, you must have a stable internet connection and compatible devices. It is your responsibility to ensure that you meet the technical requirements.

Availability:

While we strive to provide uninterrupted access to the online coaching platform, we do not guarantee continuous availability due to potential technical issues or maintenance requirements. We will make reasonable efforts to minimize any disruptions.

SHAPE IAS also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property as a result of your access to, use of, or browsing the website or your downloading of any material, data, text, images, video, or audio from the website.

We do not warrant the uninterrupted or error-free operation of the subscription. 

Any content posted on a third-party platform, by Us or any authorised third party, shall be subject to the terms and conditions, and policies, of that third-party platform in addition to the terms and conditions set forth herein. > We will process the information that We receive from You or otherwise hold about You in accordance with these Terms of Use and the Privacy Policy. You consent to the use by Us of such information in accordance with these Terms of Use and SHAPE IAS Privacy Policy.

A SHAPE IAS account is meant to be used by only one User. A user can operate their account on up to 3 devices.

Termination:

We reserve the right to terminate your enrollment in the coaching program if you fail to comply with these terms and conditions or engage in any conduct that is detrimental to the coaching institute or other participants. Termination will be at our sole discretion.in such cases, no amount will be refunded. Sharing the SHAPE IAS account credentials for both personal use and commercial purposes will result in account blockage without prior notice or warning.

If there is a suspicion of untoward or illegal activity, We may suspend your account immediately and if required, debar all future access by You to the Platform. We reserve the right to cancel any subscription as We believe has been compromised, or is being used fraudulently, at its own discretion without any financial liability to You. 

Intellectual Property Rights:

a. All materials on Website, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software, icon, logos notes (soft copies) and any and all other elements (collectively referred to as Material) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Us.

b. You may not add, delete, distort, or otherwise modify the Material. Any unauthorized attempt to modify any Material, to defeat or circumvent any security features, or to utilize the Platform or any part of the Material for any purpose other than its intended purposes is strictly prohibited and such actions will be considered a violation of the Terms of Use and will result in immediate account blockage or any such action the We deem fit.

c. All the tutors in the tutorial videos You access as part of the Services You use or subscribe for are independent third parties and not employees of the Company. The professional and technical information contained in the video tutorial is the sole responsibility of the Tutor. Even though We review the content hosted as part of the Services on a best-effort basis, We disclaim all warranties as regards the authenticity or correctness of information communicated to You by the tutors and We do not guarantee that the tutor videos contain updated information on the subject matter.

These Terms are governed by the laws of India. Any matters arising under these terms shall be subject to the exclusive jurisdiction of courts located in Delhi. 

SHAPE IAS may have to use Personal Information without reference to any persona or identity for research, statistical analysis and business intelligence purpose.

All SHAPE IAS employees and data processors, who have access to, and are associated with the processing of sensitive personal data or information, are obliged to respect

the confidentiality of every User's sensitive personal data and information.

SHAPE IAS has the right to use your data (including results, testimonials, interviews etc.) for promotional purposes.

We do not claim any guaranteed rank, mark, success/any kind of professional advantage with the use of the Platform. 

The timings of the batch and name of faculties as mentioned in the website/advertisements are tentative and may be changed under the condition of requirements for smooth functioning of classes so as to complete the syllabus on time.

Institute reserves the right to change, replace or make any addition of any new faculty member during the course of the academic session if felt necessary. 

The information and descriptions contained herein are not intended to be complete descriptions of all terms, exclusions and conditions applicable to the products and services, but are provided solely for general informational purposes. 

Software Licenses:

You acknowledge that any software available or provided to you on this website may contain technology that is subject to strict controls by various rules and regulations in India. You hereby agree that you will not transfer or export such software from India (including, for example, providing such software to any foreign person or entity in India) or re-export such software outside India in violation of Indian laws and regulations. SHAPE IAS does not authorise the downloading or exportation of any software or technical data from this website to any jurisdiction prohibited by Indian laws and regulations.

We offer You various services via the Platform, to help You prepare for the Civil Services Examination conducted by UPSC and/or various Provincial Civil Services Exams conducted by Public Service Commissions of various states.

We may, at Our discretion, revise the amount payable in respect of existing offerings forming part of the Services that may be made available to You.

Before proceeding to Online Registration Candidates must ensure:

That they have scanned images of their photograph, Photo ID Proof and signature in .jpg/.tiff format, each of the scanned images of the photograph/ID Proof/signature should not exceed 100 KB in size (for a photograph, the pixel size is 140 pixels height x 110 pixels width and for signature, it should be 110 pixels height x 140 pixels width) and to be ensured that the uploaded photograph/signature are proper. 

Fee Structure:

The fee for the coaching program will be communicated to the candidates upon enrollment. It may vary based on the selected package and the duration of the program. The terms and conditions may specify the total fee for the coaching program, payment schedules, refund policies, and any additional charges or taxes. In the unlikely event that, due to a technical error, the amount of the Fee displayed on the Platform is incorrect, SHAPE IAS will notify You as soon as it reasonably can. If the correct amount of the Fee is higher than the amount displayed on the Platform, SHAPE IAS will contact You through your registered e-mail address and/or phone number to notify You of the correct Fee. To avail of all Services for the duration of the Subscription, You may be required to remit any additional fees so that the correct Fee is paid by you. 

Course Structure:

The terms and conditions may detail the curriculum, duration of the course, and the subjects or topics covered in the coaching program.

Discussion Forums:

SHAPE IAS may include discussion forums or chat rooms. You agree to use these platforms responsibly and refrain from engaging in any form of harassment, offensive language, or inappropriate behaviour. We reserve the right to moderate and remove any content that violates these guidelines. 

Study Material:

The terms and conditions may mention whether study materials will be provided by the coaching institute, and if so, whether they are included in the fee or need to be purchased separately. You must collect the materials personally and ensure their safekeeping. Any lost or damaged materials will not be replaced.

We do not make any representation, guarantee or commitment to You that the Study Materials offered either in the demo versions or as part of subscribed services will be error-free.

Assignment: You Cannot Assign Or Otherwise Transfer Your Obligations Under The Terms, Or Any Right Granted Hereunder To Any Third Party. The firm Rights Under The Terms Are Freely Transferable By The Company To Any Third Parties Without The Requirement Of Seeking Your Consent.

Mock Tests and Assessments: The terms and conditions may include information about the availability of mock tests, assessments, and their role in evaluating the progress of the students.
